22 Project Manager •COVER STORY DISPUTE AVOIDANCE THROUGH ETI In a paper aimed at project managers in the constr uction industry, NSW Public Works' (NSWPW) Graham Watt outlined the new approach his organisation had implemented in order to avoid potential con icts arising during a project. A major part of the solution is early tenderer involvement (ETI). In the search for greater certainty of outcomes in contracts for the constr uction of assets, NSWPW developed six key actions that can be taken when tenderers are involved in the project at an early stage. • Choose the right procurement strategy. • Use the best for m of contract. • Work with tenderers to identify and allocate risk. • Ensure tenderers commence the pricing with a clear understanding of contract requirements. • Agree on KPIs and monitor team performance. • Establish working relationships before awarding any contract. e procurement approach needs to be based on budget, value for money, the sponsor's priorities, speci c requirements of the project and the ability of the industry to deliver, and it could be the most important decision. "[Procurement] is more than simply establishing a contractual relationship," Watt explains. "It creates a unique set of social relationships where for ms of power are established within a framework of competing interests and groups. It drives value for money, manages risk and sets up good working relationships on a project. "It starts key relationships between the parties that will help drive behaviours toward achieving project goals." To continue driving these behaviours in the right way, NSWPW has altered the relationship structure set up by its contracts. Cooperative contracting has been introduced, establishing a relationship-based for m of contract rather than an adversarial approach. As a result, a cooperative spirit is adopted by each party.
